On August 29, 2014, in In re Warrant to Search a Certain E-mail Account Controlled and Maintained by Microsoft Corp., the US District Court of the Southern District of New York, on request of the Government, lifted the stay of execution of an order requiring Microsoft Corp. to turn over a customer’s emails stored in response to a warrant issued under the Stored Communications Act at the end of 2013. The server in question is located in Ireland.
On July 31, 2014 the federal court upheld the magistrate judge’s ruling to turn the emails but ordered a stay of the order. Now the stay has been lifted and Microsoft should turn over the requested data.
