On June 14, 2019, the FTC reached a settlement with SecurTest, Inc., a background screening company over allegations that it falsely claimed to be a participant in the EU-U.S. Privacy Shield program.
This is the result of the FTC taking action against false claims of participating to the EU-US Privacy Shield Framework. See here.
The FTC ordered the company to avoid any misrepresentations about participation in privacy or security programs in the future. In addition, the company agreed to submit to the FTC additional compliance reports and to keep the records necessary to demonstrate full compliance with each provision of the order for the next five years.
The FTC also sent warning letters to 13 companies falsely claiming to participate in the U.S.-EU Safe Harbor and the U.S.-Swiss Safe Harbor frameworks.
