The Italian Privacy Authority (Garante per la Protezione dei Dati Personali) issued Guidelines on Spamming.
The Authority had already issued rules on spamming (General Rules May 29, 2003) but those rule were based on a privacy law (Law December 31, 1996 no. 675) that was substituted by D.lgs. June 30, 2003, no. 196 (Italian Data Protection Code)
In the new Guidelines “spamming” is defined as the sending of advertisement material, offers for sale, market survey or commercial communication which is done in violation of the Data Protection Code though automatic systems (pre-registered telephone calls, faxes, text messages, mms).
The Guidelines clarifies what is permissible spam and what is not.
